WHY MARRIAGE REGISTRATION IS MANDATORY

The Supreme Court of India, in 2006, made it mandatory to register all marriages in the eyes of the law, making it an important certificate to prove your relationship with your spouse.In 2006, the Supreme Court recommended mandatory marriage registration for people of all religions.

If you have just got married and haven’t registered your marriage yet, you should do it soon. All couples who got married in the city registered themselves in 60 days. Failure to do so will attract a fine, upto rs.1000. or as per the state rules.

WHAT IS MARRIAGE CERTIFICATE?

A Marriage Certificate proves relation between Spouses. Marriage certificates are issued by district marriage registrars in accordance with religious marriage and special marriage acts.

MARRIAGE REGISTRATION ACTS

Currently, marriage certificates are issued under two marriage registration acts:

The Hindu Marriage Act, 1955 :

When marriage is already solemnized where Husband and Wife are Hindus, Buddhists, Jain or Sikhs or once they are converted into any of those religions, they're going to be considered under these registration Act.

The Special Marriage Act, 1954

Whereas, this act lay down the procedure for both solemnization and registration of marriage certificate where either of the party or both aren't Hindus, Buddhists, Jain or Sikhs.

This certificate are often presented at many places like passport office, court, Bank, insurance offices, etc. The bride and groom should be proved to have been married on a particular date.

PROCEDURE FOR MARRIAGE REGISTRATION

Fill the web marriage registration form, by providing the specified documents. Book a meeting at the marriage register office. Once you confirm with us we'll book a meeting at register (the date you select are going to be after 1 month) office where you've got to offer your single visit with 3 Witnesses and their documents. Get the wedding Registration Certificate in 1 month.

Under Hindu Marriage Act, 1955

Schedule a meeting, visit the Registrar's Office (SRO) with three witnesses at the time of registration. Submit the application with all the specified documents and obtain a wedding certificate.

PROCEDURE FOR MARRIAGE REGISTRATION

Under Special Marriage Act 1954

Bride and Bridegroom should provides a notice of intending a wedding 30 days beforehand to marriage registration officer.

No objections should be raised within the 30 day timeframe. The parties may appear for a solemnization meeting with three witnesses within the next 30 days. If the couple didn’t not marry within 90 days of solemnization of marriage, they're going to start the procedure again. Marriage Registrar will administer the oath and solemnize the wedding by issuing the certificate Once the declaration and certificate is signed with parties and witness we are through with the method .

Under Parsi Marriage and Divorce Act, 1936

A form is crammed with the small print of Bride and bridegroom with 2 witness and certificate of marriage is issued by a priest. Along with prescribed marriage certificate fees got to be send to marriage officer. Marriage are going to be recorded with Registrar.

Aadhaar Card or Any Id Card Passport size photo Note : A set of original documents and a xerox should be carried to the Registrar's office.

ARE YOU ELIGIBLE TO APPLY FOR A MARRIAGE CERTIFICATE

The parties should be quite 21 years aged for males and 18 years for females. The parties must have lived for in any case one month within the district where marriage is to be registered. There shouldn't be quite one spouse of any of the parties at the time of marriage under Hindu Marriage Act, while consistent with Special Marriage Act it's allowed.

OFFENCES AND PENALTIES OF MARRIAGE REGISTRATION?
Any Person destroying, tampering with or dishonestly or fraudulently altering the registrar are going to be punished with imprisonment up to Five years and/ or fine of Rs. Five Thousand.
